As a Metairie area disability attorney, one of the first questions I am usually asked is How much will this cost me?
In many cases, the maximum is $6, 000 (if we win at the first hearing). That’s because I generally use the fee agreement process.

Due to SSA laws, you can be paid 12months of back benefits in this scenario (because SSA does not pay for the first 5 months).
How Much Does A Social Security Attorney Cost?
Costs include things such as expenses incurred for medical records, long-distance phone calls, mail, parking at your hearing, and other costs paid to develop your disability case.
One thing to keep in mind if you use a disability representative from a national firm that must travel to your area is whether or not those travel costs will be charged to you.
This could include airfare, rental car, hotel stay, and meals. These costs can get expensive and really decrease the amount you end up with at the end of the day.

Thus, you need to watch costs and be mindful of them when you hire a disability lawyer. The costs for national lawyers and advocates can get excessive.
There is a possibility that a disability attorney may get more than the $6, 000 if your case involves extensive work (usually because of multiple appeals to and from SSA and federal court).
In this case, the fee petition process would have to be used. Your attorney would have to file a fee petition and have it approved by the Social Security Administration.

How Much Does A Los Angeles Disability Lawyer Cost?
For most people, a claim for disability benefits comes at a time when money is particularly tight. Paying for a lawyer might seem impossible.

However, the Social Security disability system is structured in a way that allows almost everyone with a disability claim, no matter how pressed for funds, to pay for competent legal representation by paying the lawyer at the END of the case, and ONLY if you win your claim for benefits.
Almost all fee agreements between lawyers and disability clients involve a type of contingent fee. “Contingent” in this context means that there is no fee due unless you win your case.

Furthermore, the Social Security Administration (“SSA”) must approve all fee agreements between claimants and attorneys. They normally limit the attorney fee to 25% of the “backpay” (otherwise known as “past due benefits”) or $6, 000, whichever is less. “Backpay” or “past due benefits” are those that build up while you are waiting for your case to be approved.
For most people who apply for benefits, it takes a while (sometimes two years or more) to get through the system. If your health condition became disabling around the time you stopped working, you could be owed benefits for that entire time it takes to get through the system and start receiving benefits. Once you win your claim and SSA computes your backpay, they will pay your attorney directly out of that backpay.
Now, the contingency fee arrangement is the most common fee structure for attorneys in disability cases. But as with most rules, there are exceptions. There are certain times when a disability attorney can charge more than the $6, 000 cap mentioned above.

Keep in mind, if you fall into any of the categories requiring your attorney(s) to file a fee petition and you think the attorney is asking for too much, you are able to object to the amount the attorney asks for.

Most applicants for disability income are under severe financial stress; they have lost needed income and are struggling to pay medical expenses.
Because of this, the Social Security Administration has established guidelines for legal assistance that makes hiring an attorney feasible. Social Security Disability lawyers work on a contingency basis, meaning the attorney collects a fee only if you win your case and are awarded disability benefits. If you are not approved for disability benefits, the attorney charges nothing. The attorney works on your case until Social Security issues a decision and you pay nothing until the end of the case. Social Security disability attorneys do not charge up-front fees or require a retainer; instead, federal law allows attorneys to charge only 25% of past-due or back pay benefits you are awarded, up to a maximum of $6, 000, whichever is less. Back pay is retroactive benefits a claimant is owed and is calculated from the date disability benefits are granted to the date that Social Security determines the disability began (which can be a maximum of 12 months back from the date of the claimant’s application).
Social Security disability attorneys will enter into a fee agreement with their clients and submit this fee agreement to Social Security for approval at the beginning of the case.

Social Security must review the agreement to ensure it meets legal requirements and the attorney is not taking advantage of the client by receiving more than is legally allowed. There are two main requirements. The fee cannot be more than 25% of the claimant’s back pay or $6, 000. For example, if the claimant’s back pay is $10, 000, the attorney will receive $2, 500 and the claimant $7, 500. Also, the fee agreement must be signed by the applicant (or the applicant’s guardian) and the attorney. If Social Security approves the fee agreement, Social Security will pay the attorney out of the claimant’s back pay when disability benefits are granted.

If a claimant goes through a hearing, it will extend the time between the claimant’s disability onset date and the date benefits are granted. The reason
